Abstract: To reach the strategic goal of marine power construction, four transformations proposed by Xi Jinping must be really enforced.The optimal allocation of marine resources and the construction of market oriented use rights transfer of sea areas are fundamental to promote quality based marine economy and increase utilization efficiency of marine resources.Legal system design and management mechanism improvement for use rights transfer of sea areas are the important research contents of market based allocation of marine resources, however, the current legal system only make principal regulation and lack concrete and operative enforcement items, impeding the marketing process of use rights transfer of sea areas.Therefore, the improvement of the legal system for use rights of sea areas to alleviate the legal restriction and thus promote the marketing process of sea areas use rights transfer has much implication for the optimal allocation of marine resources and the construction of marine power.
